What is CCPA?

The CCPA stands for the California Consumer Privacy Act. The CCPA is a California consumer privacy law that requires businesses to make certain disclosures to California consumers regarding the collection, use, and disclosures of personal information. In addition, the CCPA grants California consumers certain rights with respect to the personal information that businesses collect about them. The CCPA first took effect in 2020 and has since been amended by the California Privacy Rights Act of 2020. What about other state privacy laws?

Since the CCPA was passed, several other states have passed consumer privacy laws that, among other things, give applicable consumers certain rights with respect to the personal information that businesses collect about them, and require businesses to provide certain information and notices to consumers regarding the collection, use, and disclosures of personal information and consumers’ privacy rights. How do these privacy state laws affect me?

The state consumer privacy laws may give you certain rights with respect to the personal information that businesses collect about you. How do I submit a privacy rights request?

To submit a consumer rights request, the preferred method is to submit a request through the Hyundai personal information request portal:

Is the website the only way to submit a request?

No, you may make certain requests to us by contacting as at: (800) 633-5151 (toll free). However, if you submit your request through the personal information request portal, you will be able to track the status and progress of your request online.

 

Can someone submit the request on my behalf?

Yes, you may authorize an agent to submit a request on your behalf. Please note that we will require the agent to certify and provide proof that they are authorized to make a request on your behalf, and, in some circumstances, we may require you to verify your identify yourself and the authority of your authorized agent.

 

I don’t have a computer, what do I do?

You may also submit a request by using your smart phone or via a public computer in a local library. Also, you may submit requests to us by contacting as at: (800) 633-5151 (toll free).

 

How long does the request take?

We will respond to your request within the timeframe required by these applicable laws. We endeavor to respond to most verifiable requests (including to access, correct and delete personal information) within 45 days. In some circumstances, we may need additional time, in which case we will notify you that we may need up to an additional 45-days to process your request. For certain requests (such as request to opt out of sales and sharing or limit certain uses or disclosure of sensitive personal information), we will endeavor to respond within 15 business days.

 

How do I get an update?

In the Personal Information Request page, select the “Check Status of a Previous Request” and enter your request number received from Hyundai via email OR you will be notified via email when your data report is ready.

 

It has been 45 days and I still have not received my report, what do I do?

You will receive a notification if we cannot satisfy the request in 45 days. If you have not received a notice or your report within 45 days, please search your inbox and your spam folder for an email from hyundai@e.hyundaimotors.com. If you are still unable to locate the notice, you can contact, please contact the Consumer Assistance Center at https://owners.hyundaiusa.com/us/en/contact-us.html or via telephone at 1 (800) 633-5151. 

 

What does an access/request to know report contain?

If you make a request for a copy of the personal information we have collected about you , we will provide you with a document that includes the specific pieces of personal information that we have collected about you during that time.

If you make a request to know categories of information we have collected about you, we will provide you with a document that describes:

  • The categories of personal information collected;
  • The categories of sources of personal information;
  • The business and/or commercial purposes for collecting and selling their personal information;
  • The categories of third parties with whom the business shares personal information;
  • The categories of personal information that the business sold and for each category identified, the categories of third parties to whom it sold that particular category of personal information; and
  • The categories of personal information that the business disclosed for a business purpose and the categories of third parties to whom it was disclosed.

What information can I request to be deleted?

You can request that we delete your personal information, but please note that there are several exceptions to deletion requests.

 

What customer information does not get deleted and why?

The are several exceptions to a consumer’s right to have their information deleted. These may include but are not limited to, the following reasons:

  • Hyundai is unable to verify your identity.
  • Your personal information is necessary to:
    • Complete the transaction for which the personal information was collected, provide a good or service requested by you, or otherwise perform a contract between the business and the California resident.
    • Detect security incidents, protect against malicious, deceptive,    fraudulent, or illegal activity; or to prosecute those responsible for that activity.
    • Debug to identify and repair errors that impair existing intended functionality.
    • Enable solely internal uses that are reasonably aligned with the    expectations of the California resident based on the consumer’s    relationship with the business.
    • Comply with a legal obligation.
    • Protect or defend our legal rights.

 

What do I do if Hyundai refuses to delete the information I request?

Privacy laws provide several exceptions to a consumer’s right to have their information deleted, as noted above. If we deny your request to delete your personal information, you may submit a request to appeal our decision by submitting an appeal request through Hyundai’s personal information request portal:

How long does it take Hyundai to delete the information?

We endeavor to respond to verifiable requests to delete personal information within 45 days. In some circumstances, we may need additional time, in which case we will notify you that we may need up to an additional 45-days to process your request.

 

Do you share any information with other companies?

How many times can I request the report?

You can request your data or a copy of your report twice in a 12-month period.

 

I forgot or can’t find my confirmation number to follow up on my request. What do I do?

How do I know my request went through?

If I request my information be deleted will future collection of this data also be deleted?

No, when you request deletion of your personal information, subject to any applicable exceptions to deletion, we will delete the personal information we have in our then-current records. We may collect additional information from you in the future, including information that you provide directly to us and as we may otherwise collect as described in our Privacy Policy https://www.hyundaiusa.com/privacy-policy.aspx.

Why did I not receive all the information in my access report?

Hyundai/Genesis will not provide certain information such as driver’s license number, credit card information and other sensitive information. We will also not provide personal information where doing so would violate applicable laws or the rights of others. In addition, will not provide information you have given our authorized dealers/retailers that has not been shared with us.  Our dealers are independent companies. If you wish to submit a request regarding your personal information held by a Hyundai dealer, you should contact that dealer directly.
